Terms and Conditions

DES, Inc. (“DES”) is dedicated to providing goods and services that meet or exceed its customers’ expectations.  Products and services furnished by DES are sold only on the terms and conditions stated herein and additional or conflicting terms or conditions proposed or offered by the customer are hereby rejected. The customer’s acceptance of any product or service shall be deemed acceptance of and ascent to these terms and conditions. By accepting these terms and conditions, the customer understands that the products and services sold to it by DES are sold “as is” and without any kind of warranty.

No Liability

In no event shall DES, Inc., or any of its officers, director or employees, be liable for loss, damages, claims, or suits arising out of or in any way connected with the customer’s use of DES’s Website.

Privacy

Information provided by the customer to DES through DES’s website (i.e. email, address to ship) that personally identifies the customer will not be distributed to or shared with any third party by DES, and will never be made publicly visible by DES. DES will only use the customer’s email and address to communicate with the customer for purposes of responding to any questions or concerns the customer may have, to create a shipping document, or to process any returns/refunds that may arise.

Price and Payment

All prices are subject to change without notice. Unless otherwise stated in writing by DES Inc., all prices shall be exclusive of transportation, insurance, taxes (including, without limitation, any sales and use tax levied on or assessed by DES, Inc.), customs fees and other similar charges. Delivery costs will be added to the total amount due for product when the customer views the item(s) in its shopping basket and has selected a chosen delivery method.

Payment for all orders must be made by credit or debit card on the checkout page. DES accepts payment by most major credit and debit cards. PayPal and the use of Stripe for a secure payment process may also be utilized on this site.

Acceptance

DES, Inc. reserves the right to ship orders complete with yield quantities. Justified parts within yield quality limits shall be credited to the Customer’s account if these cannot be replaced. Each product furnished by DES, Inc. shall be deemed accepted by the Customer unless written notice of defect or nonconformity is received by DES, Inc. within ten (10) days of delivery. All products accepted shall be paid for regardless of any claim arising from separate orders placed by the customer for other deliveries or products.

Dispute Resolution

Please contact customer service with your concerns, using our Contact Us page, so that we can resolve them to the customer’s satisfaction. In the unlikely event that the customer is not satisfied with DES’s customer service’s solution, the customer has the right to initiate a claim against DES in accordance with the process set forth below.

All disputes arising out of or relating to any transaction governed by these Terms and Conditions shall be resolved by arbitration in accordance with the American Arbitration Association’s then-current Consumer Arbitration Rules.  DES and the customer agree that any such arbitration shall be conducted in Pittsburgh, Pennsylvania, which is the place where the parties formed their agreement, where the goods were shipped from and/or the services were performed.

Returns/Refunds

DES hopes that its customers are completely satisfied with items they purchase from DES. However, if the customer is not satisfied for any reason, it may return the item(s) to DES in its original packaging (to include all pieces, instructions, etc.). The customer is responsible for the return shipping. DES strongly recommends that the customer use a trackable method when returning an item. All returns must be postmarked within 15 days of the purchase date.

To return an item, the customer will need to use DES’s Contact Us page to email DES to obtain a Return Merchandise Authorization (RMA) number. After receiving this unique number, the customer must place all of the items securely in their original packaging and include its proof of purchase, along with the RMA # and send it to DES, Attn: Returns, addressed as follows:

After receiving the return and inspecting the condition of the returned items, DES will process the return. Please allow at least 5 days from the receipt of an item to process a return. Refunds may take 1-2 billing cycles to appear on the customer’s credit card statement, depending on the customer’s credit card company. DES will notify the customer by email when its return has been processed.

Please Note – All sale items are FINAL SALE and cannot be returned.

 

Changes to this Agreement

DES, Inc. reserves the right to modify these Terms and Conditions at any time. The customer’s decision to continue to visit and make use of DES’s site after such changes have been made constitutes the customer’s formal acceptance of and assent to any new or changed Terms and Conditions. Therefore, DES asks that its customers check and review DES’s Terms and Conditions for such changes on an occasional basis. Should the customer not agree to any provision of DES’s Terms and Conditions, DES asks that the customer not cease using DES’s site immediately.
